Higher fines for failing to declare foreigners’ temporary residence in Vietnam

On October 30, the Vietnamese government issued Decree No. 282/2025/ND-CP introducing a series of tougher deterrent measures, notably higher fines for accommodation establishments that fail to declare foreigners’ temporary residence as required by law.

The decree, which took effect from December 15, regulates administrative sanctions in the areas of security, public order and social safety, as well as the prevention and control of social evils and domestic violence.

Failing to declare temporary residence for foreigners is not only an administrative violation but also poses potential risks to security and public order, and may be exploited to conceal criminal or illegal activities.

A fine of VND3 million to VND5 million (US$113.98 to $189.97) will be imposed on accommodation providers that fail to declare temporary residence for one to three foreigners; create user accounts with false information to declare foreigners’ temporary residence on electronic systems; or in cases where foreigners fail to present passports or valid international travel documents and residence-related papers for temporary residence declaration.

Accommodation providers that fail to declare temporary residence for four to eight foreigners will face fines ranging from VND10 million to VND15 million ($379.94 to $569.91).

Those that fail to declare temporary residence for nine or more foreigners will be fined between VND15 million and VND20 million ($569.91 to $759.88).

Violating accommodation establishments will be subject to inspection, on-the-spot penalty records, and administrative fines, and may be recommended for business license revocation if repeat violations occur.

All cases of non-declaration, late declaration, or false declaration will be strictly handled in accordance with Decree No. 282/2025/ND-CP.
